Should the applicant wish to utilize subcontractor’s resources and references during the tendering stage, the subcontractor is to give its written commitment to the applicant where the subcontractor undertakes to act as the applicant’s subcontractor in the project in the event the Finnish Transport Agency chooses the applicant to carry out the project. The applicant is to enclose a written commitment in its participation notice. The applicant shall submit all that information on the subcontractor that the applicant wishes to invoke during the tendering stage.
The subcontractor relations provided during the tendering stage are to be realistic and aimed for the performance of the work itself. Subcontractors should not be named during the tendering stage solely for the purpose that the applicant would succeed well in the election of tenderers participating in the competition. If a subcontractor included in the tendering stage falls out during the contract awarding procedure prior to the conclusion of the contract award, the applicant is to name a new subcontractor instead who fulfils the minimum requirements and criteria for the selection at least as well as the one retreating from the project. Otherwise the applicant shall be excluded from the competition.
The same subcontractor may give a commitment on subcontracting to several applicants and several applicants may utilize the resources and references of the one and the same subcontractor.
The written commitment provided by the subcontractor may be for example as follows: The company xx undertakes to act as the subcontractor of the applicant yy in the PPP project if the applicant’s offer leads to the conclusion of a service agreement with the Finnish Transport Agency in the PPP project.
The written commitment given by the subcontractor to the applicant is to be made in Finnish.
